4. Pricing and Payment

• All prices are displayed in AUD ($) unless otherwise stated
• Payments must be made in full at the time of order using available payment methods on our site
• We reserve the right to refuse any order if fraudulent activity is suspected

5. Shipping and Delivery

• We currently offer shipping to Australia only
• Products are shipped from our international supplier warehouses to ensure authentic products at competitive prices

6. Returns and Refunds

• We accept returns in accordance with our Return and Refund Policy
• Returned items must be unused, in their original packaging, and sent within the specified return period
• Some items may not be eligible for return for hygiene or safety reasons
• For defective or incorrect items, we provide prepaid return labels at no cost to you

8. Limitation of Liability

Nothing in these terms limits or excludes your legal rights as a consumer under Australian Consumer Law (ACL), including rights relating to:

To the maximum extent permitted by applicable law, Aussie Surplus will not be liable for:

• Commercial losses or loss of profit
• Misuse of products contrary to provided instructions

This limitation does not apply to rights that by law cannot be excluded or limited.

9. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Latvia, the country of registered office of the website's editor (FPFM SIA), in matters of contract interpretation. However, FPFM SIA acknowledges that the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) applies to all goods and services supplied to consumers in Australia. The statutory consumer guarantees set out in Part 3-2 of the Australian Consumer Law cannot be excluded, restricted or modified by contract (Australian Consumer Law, sections 64 and 64A), and any term of these Terms which purports to substitute the law of Latvia (or any other foreign law) for the Australian Consumer Law in relation to a supply to a consumer is, to that extent, of no effect (Australian Consumer Law, section 67).

• You may also access external dispute resolution through the relevant consumer protection body in your state or territory

Australian consumers may bring proceedings in the courts or consumer tribunals of their State or Territory of habitual residence (for example NCAT, VCAT, QCAT or the equivalent body in your jurisdiction). Nothing in these Terms operates to deprive Australian consumers of their rights to commence proceedings before any competent Australian court or tribunal, nor to waive their right to participate in any class or representative proceeding.
